Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the Longleaf Fundraising website and services.

Longleaf Fundraising is a division of TraQR Software, LLC, an Alabama limited liability company. References to "Longleaf Fundraising," "we," "us," or "our" include TraQR Software, LLC where applicable.

By using our website, participating in a fundraiser, or placing an order, you agree to these Terms.

1. Longleaf Fundraising Services

Longleaf Fundraising provides fundraising programs for schools, athletic teams, booster organizations, nonprofit organizations, and other participating groups.

Depending on the fundraiser, Longleaf Fundraising may provide:

  • Online fundraising and ordering systems
  • Customer order and payment processing
  • Product procurement
  • Product delivery
  • Fundraiser reporting and order tracking
  • Coordination with participating organizations
  • Optional installation or related services when offered

The exact products, services, pricing, fundraising proceeds, and fulfillment procedures may vary by fundraiser.

2. Orders

Customers are responsible for providing accurate information when placing an order, including contact information, delivery address, quantities, and any relevant delivery or installation instructions.

Orders may be subject to product availability, delivery limitations, scheduling requirements, and other operational considerations.

We reserve the right to reject, cancel, or modify an order when reasonably necessary because of product availability, incorrect pricing, suspected fraud, delivery limitations, or other circumstances affecting our ability to fulfill the order.

If we cancel an order that has already been paid, the applicable amount will generally be refunded.

3. Pricing and Payment

Prices displayed during checkout are the prices applicable to that particular fundraiser and order at the time of purchase.

Applicable taxes, fees, delivery charges, installation charges, or other costs will be disclosed when applicable.

Payment is generally required when an order is submitted unless otherwise stated.

4. Fundraising Proceeds

A portion of qualifying sales may benefit the school, team, organization, or other group associated with the fundraiser.

The amount earned by the organization is governed by the fundraising arrangement between Longleaf Fundraising and the participating organization.

A customer's purchase is a commercial transaction for products and/or services and should not be considered a charitable contribution unless expressly stated otherwise.

Longleaf Fundraising does not guarantee that any portion of a customer's purchase is tax deductible.

5. Product Delivery

Delivery dates and timeframes are estimates unless expressly guaranteed in writing.

Customers are responsible for providing accurate delivery information and reasonable access to the delivery location.

Unless otherwise agreed, delivery may be completed by placing products in a reasonably accessible location at the address provided by the customer.

Longleaf Fundraising is not responsible for delays caused by severe weather, supplier delays, transportation issues, inaccessible properties, incorrect customer information, acts of God, or circumstances outside our reasonable control.

6. Optional Installation

Some fundraisers may offer installation as an optional service.

If installation is selected, the customer agrees to provide reasonable access to the property and to identify any areas where the product should or should not be installed.

Installation is intended to be a basic product placement or spreading service unless otherwise specifically described.

Customers are responsible for notifying Longleaf Fundraising or the participating organization of known hazards, underground irrigation components, landscape lighting, pet containment systems, fragile landscaping, or other conditions that could reasonably affect installation.

7. Property Access

When delivery or installation requires access to private property, the customer represents that they own the property or have permission to authorize access.

The customer authorizes Longleaf Fundraising, participating organization representatives, delivery personnel, volunteers, contractors, and other authorized persons to enter the reasonably necessary portions of the property to complete the requested delivery or installation.

8. Schools, Teams, Volunteers, and Participating Organizations

Participating organizations may assist with promoting the fundraiser, selling products, communicating with supporters, delivering products, or providing installation services.

The specific responsibilities of each organization may vary by fundraiser.

Longleaf Fundraising may provide technology, products, logistics, coordination, and other support while participating organizations and their volunteers perform certain fundraising or fulfillment activities.

9. Refunds and Cancellations

Because fundraising orders may involve advance product purchasing and coordinated delivery, cancellations and refunds may be limited after an order deadline or after products have been ordered for fulfillment.

If you believe your order is incorrect, damaged, incomplete, or was not delivered as expected, please contact us promptly so that we can attempt to resolve the issue.

Refunds, replacements, or credits will be determined based on the circumstances of the order and applicable law.

10. Product Variations

Natural products, including pine straw and other landscaping materials, may vary in color, size, texture, moisture content, appearance, and coverage.

Photographs, coverage examples, and quantity recommendations displayed on our website are intended as estimates or visual guides and are not guarantees of exact appearance or coverage.

Customers are responsible for determining the quantity appropriate for their property.

11. Website Accounts and Information

If our website allows you to create an account or access fundraiser-specific information, you are responsible for maintaining the confidentiality of your login credentials.

You may not attempt to gain unauthorized access to another person's account, fundraiser information, or any restricted portion of our systems.

12. Communications

By providing your contact information, you agree that we may contact you regarding your order, fundraiser participation, delivery, installation, customer service requests, or other transactional matters.

Marketing text messages will only be sent where appropriate consent has been obtained. Consent to receive marketing text messages is not required as a condition of purchasing products or services.

You may opt out of non-essential SMS communications by replying STOP.

13. Intellectual Property

The Longleaf Fundraising name, branding, website content, graphics, software, program materials, and related intellectual property are owned by or licensed to TraQR Software, LLC unless otherwise indicated.

They may not be copied, reproduced, distributed, or commercially used without permission.

14. Prohibited Use

You may not use our website or services to:

  • Engage in fraudulent or unlawful activity
  • Interfere with website security or operation
  • Attempt unauthorized access to our systems
  • Misrepresent your identity or affiliation
  • Submit false or misleading order information
  • Copy or commercially exploit our website, software, or fundraising materials without authorization

15. Disclaimer of Warranties

To the extent permitted by law, our website, products, and services are provided on an "as available" basis.

Except for warranties that cannot legally be excluded, Longleaf Fundraising and TraQR Software, LLC disclaim implied warranties to the maximum extent permitted by applicable law.

16. Limitation of Liability

To the maximum extent permitted by applicable law, TraQR Software, LLC, Longleaf Fundraising, and their owners, employees, contractors, representatives, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our website, products, fundraising programs, delivery services, or installation services.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless TraQR Software, LLC and Longleaf Fundraising from claims, damages, or expenses resulting from your unlawful use of our services, violation of these Terms, or material misrepresentation of information provided to us.

18. Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles.

Any dispute arising from these Terms or the use of Longleaf Fundraising services will be subject to the jurisdiction of the appropriate courts located in Alabama, unless otherwise required by applicable law.

19. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect.

20. Changes to These Terms

We may update these Terms periodically to reflect changes to our services, business practices, or legal requirements.

Updated Terms will be posted on this page with a revised effective date.
